Terms of Service

These Terms of Service ("Terms") govern your access to and use of BuildTrack, a cloud-based construction project management platform ("Service") operated by PM Tools by a PM ("we", "us", or "our"). By accessing or using BuildTrack, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 18 years old, have the authority to enter into this agreement, and agree to comply with these Terms and all applicable laws.

2. Description of Service

BuildTrack provides cloud-based tools for construction project management, including but not limited to:

• Project progress tracking and scheduling
• Budget and cost management
• Risk register and issue logging
• Daily site activity reports
• Non-conformance management
• Payment certificate generation

3. Subscription Plans & Billing

BuildTrack is offered on a subscription basis. By subscribing, you agree to pay the applicable fees for your chosen plan (Starter, Pro, or Agency). Subscriptions are billed monthly or annually in advance. All fees are non-refundable except as described in our Refund Policy.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

4. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Reverse engineer, copy, or redistribute the Service
• Upload malicious code or interfere with the Service's operation
• Resell or sublicense access to the Service without written permission

6. Intellectual Property

All content, features, and functionality of BuildTrack — including software, design, text, and graphics — are owned by PM Tools by a PM and protected by applicable intellectual property laws. Your data remains your property; we claim no ownership over content you upload.

7. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We take reasonable measures to protect your data but cannot guarantee absolute security.

8. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may cancel your subscription at any time through your account settings. Upon termination, your access to the Service will cease and your data may be deleted after 30 days.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, PM Tools by a PM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Trinidad and Tobago, without regard to conflict of law principles.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
